Will & Living Will

A will is the first step in creating an estate planning strategy.  Your will outlines how your financial affairs should be handled after your death.  Most importantly, it gives directives as to who should inherit your estate, and any conditions or limitations set forth on the bequests.  If you have minor children or a loved one who is mentally incapacitated, a will secures a new guardian, of your discretion, to be appointed for the individual in need.  Your will further names an executor of the estate who is responsible managing your property and abiding by the directives set forth in your legal document.

Another very important estate planing devise is a Living Will.  Every individual, no matter their economic status, should have a living will.  With this instrument, you appoint an agent who will be responsible for making medical decisions on your behalf in the event you suffer from a serious disability that strips of your decision-making ability. You get to state your wishes as to who should take care of you and what should be done in the event you fall into a coma or a vegetative state.

Be mindful of every important life changing circumstance and how it could effect your property distribution at the time of your death.  To that extent, changes to your estate plan may be necessary.  If you are going through a divorce, have a new addition to your family, or have decided to disinherit an heir, now is it the time to update your will and any supplementary trust.  Contact an estate planning lawyer in Staten Island to address any necessary changes in your will, living will, power of attorney and all other estate planning documents.

Probate & Estate Administration

Probate and administration proceedings are filed in the Surrogate’s Court in the county where the decedent had his primary residence.  Our firm has extensive knowledge in the various nuances that typically occur during the probate and administration process.  We take pleasure in assisting named executors and personal representatives by:

• Establishing a devised plan and strategy in order to expedite the probate of the estate.
• Filing the Last Will & Testament of the decedent and all supporting legal documents in Surrogates Court.
• Valuing and appraising the assets that compromise the estate.
• Paying all required taxes including income taxes of the deceased and estate taxes.
• Locating all heirs and beneficiaries named under the will.
